Additionally, the court granted an interim injunction preventing the government from arresting or deporting any ZEP permit holder.
The department has faced heavy criticism for not following the proper procedure to end the regime, which allows more than 178,000 Zimbabweans to stay and work in South Africa.
“The loss of the Department of Home Affairs was already expected, and the minister was aware of it, and the department was also aware of it,” Sibanda said.
“In fact, I think the department did it for politicking purposes and to drag it further to make it seem like they don’t like immigrants and foreigners to capture that group of people who don’t like foreigners.
“Zimbabweans who hold SPA permits should keep them valid so that if they need to be extended, they do not miss out on that opportunity.”
